GENERAL RENTAL CONDITIONS

Article 1 – Purpose of this contract

The rental of a cycle with its basic equipment by VELOCOUEST below referred to as “the rental company”, via the Ouibike marketplace or reservation module or directly from VELOCOUEST.

Article 2 – Cycle equipment

All rented cycles have basic equipment consisting of the following accessories:

- Electric assistance system (Motor, Battery and console), for any electrically assisted bicycle

- Anti-theft,

Article 3 – Taking effect, making available and recovery

The rental takes effect at the moment when the tenant takes possession of the equipment and accessories delivered to him from VELOCOUEST. The risks will be transferred upon delivery of the equipment and accessories to the tenant who will assume custody of them under his entire responsibility, the latter hereby committing to use them in all circumstances “as a good father of a family”. This contract is only in force for the duration of the rental. If the tenant keeps the equipment beyond this period without having regularized his situation, he loses the benefit of all the guarantees provided for in the contract.

The tenant acknowledges having received the rented item in good working order with the basic equipment. He declares that he personally had complete freedom to check the equipment and choose it according to his needs.

For delivery, the times selected by the tenant when booking online are indicative. Indeed, Véloc’Ouest reserves the right to adjust said times taking into account the delivery location and the quantity of bicycles required. In return, the lessor undertakes to notify the tenant and obviously do its utmost to find the best solution for the tenant.

Article 4 – Payment and methods of payment for the service

The entire service is paid by the tenant at the time of borrowing the equipment covered by this contract. Payment is made at the time of booking on the Lokki website, by credit card from the Stripe banking establishment.

Article 5 – Use

The tenant certifies that he is fit, has no medical contraindications, is not under the influence of alcohol or narcotics and can use the rented equipment, which he undertakes to use himself.

From the moment the Bicycle(s) and Accessories are made available, the Renter has custody of them and is solely responsible for them as well as for any consequences that may result from their use.

The Renter is solely responsible for violations of the Highway Code relating to the driving or keeping of the Bicycle(s) and Accessories, or for any other violation of the legislative, tax and regulatory provisions in force, committed during the duration of the rental. CONTRACT.

The Renter acknowledges having taken note of the fact that the rental company provides helmets for each bicycle rented and very strongly advises adults to wear helmets, for safety reasons. Concerning minors under 12 years old, wearing a helmet has been compulsory since March 22, 2017. The rental company cannot be held responsible in the event of the customer's refusal to wear a helmet.

The Bicycle(s) and its Accessories must not be used in an abnormal manner, in particular:

• outside of vehicle roads;

• for the transport of passengers for payment;

• for towing or pulling any object, other than those provided by the rental company;

• for the transport of a passenger, except for the transport of a young child, provided that an approved seat is installed.

By express agreement between the parties, the loan or subletting of equipment is strictly prohibited. The tenant is strictly prohibited from working on the equipment in the event of a breakdown. The tenant undertakes to use the rented item with caution, without danger for third parties in accordance with the regulations in force,

When parking the equipment on public roads, it is obligatory for the tenant to install the anti-theft device and attach it by the frame to a fixed attachment point.

In the event of theft of equipment, the tenant must immediately notify the lessor, file a complaint with the authorized authorities and provide a photocopy of the complaint.

Article 6 – Breakage – theft liability

The tenant releases VELOCOUEST from any liability arising from the use of bicycles, particularly with regard to the bodily, material and immaterial consequences of accidents of all kinds, and compliance with the Highway Code.

The tenant declares that he holds personal civil liability insurance which guarantees liability incurred during the use of the rented bicycles both by himself and the people in his care, or even his employees.

However, the tenant cannot be held responsible for the harmful consequences of hidden defects in the rented equipment or non-apparent wear and tear unsuitable for the use for which it is intended, provided that proof of said defects or wear can be provided by the tenant.

The tenant does not benefit from any coverage for damage suffered by the rented item and is personally liable for said damage.

In the event of theft by the lessee, misappropriation or any damage resulting from non-compliance with the rules of use or the regulations in force, or the terms and conditions of this contract, the lessor is entitled to exercise recourse for the entirety of the harm.

Article 7 – Insurance and Assistance

Velocouest offers two distinct insurance policies: the first covers risks linked to breakage and theft, the second covers assistance and repairs. To guarantee optimal protection, the two options can be combined.

Article 7.1 – Breakage & Theft Insurance

The Breakage and Theft Insurance option offers coverage for damage related to breakage or theft of rented equipment.

• Thus, in the event of theft, the tenant is liable for a deductible of 10% of the value of the equipment. The filing of a complaint by the tenant is obligatory. Without proof of said complaint, the tenant is required to fully reimburse the stolen items.

• Likewise, in the event that the equipment is broken during rental, a deductible of 10% of the value of the damaged parts is applicable at the expense of the tenant.

If the tenant chooses not to take out breakage and theft insurance, then his liability is incurred in the event of theft or damage to the rented equipment.

• Thus, in the event of theft, the tenant is required to fully reimburse the stolen items.

• Likewise, in the event that the equipment is broken during rental, the tenant is required to reimburse all parts to be repaired or replaced.

If the tenant does not subscribe to Breakdown Assistance, Véloc'Ouest reserves the right to charge €0.50 (50 cents) per kilometer traveled round trip, for any intervention on a problem for which it is not responsible, and this regardless of whether or not you subscribe to Breakage & Theft Insurance.

Article 7.2 – Troubleshooting Assistance

The Breakdown Assistance option allows the tenant to benefit from assistance in the event of a breakdown.

Véloc’Ouest then undertakes to do its utmost to intervene within 24 hours, in its Delivery Zone defined on the online reservation tool. This option is valid only once per subscription. Véloc'Ouest reserves the right to use a third-party service provider for assistance.

Activating the assistance option offers the possibility of benefiting from a repair or exchange of the damaged bicycle. All human transport is excluded from this assistance. In fact, Véloc’Ouest is not authorized or registered as a passenger transport company.

If the tenant does not wish to subscribe to the assistance option:

• In the event of a breakdown or defect on the rented bicycle, excluding any liability on the part of the tenant, Véloc’Ouest undertakes to intervene as soon as possible.

• Véloc’Ouest reserves the right to charge €0.50 (50 cents) per kilometer traveled round trip, for any intervention on a problem for which it is not responsible.

If the tenant does not subscribe to Breakage & Theft Insurance, Véloc'Ouest reserves the right to invoice all parts to be repaired or replaced, the same for the stolen bicycle, regardless of subscription or not. , to Roadside Assistance.

If the tenant subscribes to Breakage & Theft Insurance, Véloc'Ouest reserves the right to charge a deductible of 10% of the value of the damaged parts or the stolen bicycle, regardless of whether or not they have subscribed to the insurance. Troubleshooting assistance.

Article 8 – Identity document

The tenant must present proof of identity.

Article 9 – Restitution

The return of rented equipment will be made 15 minutes before the closing times of the rental points. Beyond these times, in the event of a delay, ½ day will be additionally billed to the tenant.

For safety reasons, the tenant undertakes to notify the rental company of any impacts suffered by the helmets.

Article 10 – Eviction of the lessor

The accessories delivered with the equipment must not be removed or modified by the tenant.

The equipment cannot be transferred or given as a guarantee. The tenant generally undertakes not to grant with regard to the thing rented any right, real or otherwise, for the benefit of anyone, likely to affect its enjoyment or limit its availability or full capacity. property of the lessor.

Article 11 – Obligations of the Tenant in the event of accident or theft

The Tenant undertakes to notify VELOCOUEST of the loss, in all cases, as quickly as possible and at the latest within 24 hours (twenty-four hours) of the occurrence of the loss. The Tenant further undertakes:

a) In the event of an accident, to be sent within 48 hours (forty-eight hours), or 2 working days (two days) to VELOCOUEST even in the event of only material damage suffered by the Bicycle(s) and Accessories, the original of the amicable report duly and legibly completed (failing this, the claim declaration including all useful details on the circumstances of the claim, the contact details of the driver of the Bike(s), those of the adversary and his insurer as well as those of the witnesses, the damage suffered by the Vehicle(s) and/or accessories)

b) In the event of theft of the VAE(s) and Accessories, or vandalism, the Renter is required to report the theft or vandalism as soon as the damage or disappearance is noted to the police or gendarmerie authorities, to declare and provide the certificate of filing a complaint with VELOCOUEST within 48 hours (forty-eight hours) or 2 working days (two days) of the damage or disappearance being noted. On request, any supporting documentation may be requested from the Renter to justify the loss.

The Tenant who is in bad faith, exaggerates the amount of damage, claims to have destroyed objects or goods that did not exist at the time of the disaster, conceals or removes all or part of the objects taken in charge, uses fraudulent means or documents as justification. inaccurate, is forfeited of any right to the guarantee for the loss in question.

Article 12 – Jurisdiction

In the event of any dispute relating to this contract, or for any dispute which cannot be resolved amicably, jurisdiction is assigned exclusively to the Judicial Court of VANNES for a legal entity, and in the case of a natural person. , jurisdiction is attributed to the competent court in accordance with article L.141-5 of the Consumer Code.
